General Terms and Conditions of Sale and Use of the KStory España online store.
Last updated: 24 April 2026These General Terms and Conditions (hereinafter, the "Terms") govern the access, browsing and use of the website kstoryespana.com (the "Website") and the purchase of products offered through it by K MOMENT EUROPE SL (hereinafter, "KStory España", "we" or "us").
KStory España operates a physical and online retail store specialised in Korean pop culture products (K-POP albums, merchandise, photocards, light sticks, magazines and related items), importing directly from authorised distributors in South Korea.
By accessing, browsing or placing an order through the Website, the user ("Customer" or "User") expressly accepts these Terms, as well as our Privacy Policy, Cookie Policy, Returns & Refunds Policy and Pre-Order Policy.
If the User does not agree with any of these Terms, they must refrain from using the Website.
Browsing the Website is free. To place an order the User may check out as a guest or create a user account providing a valid email address.
To register and place orders the User must be at least 18 years of age or, if a minor, have the authorisation of a parent or legal guardian. The User is responsible for the accuracy of the data provided and for the safekeeping of their access credentials.
The products offered on the Website, together with their main characteristics and price, are described with the maximum possible accuracy. Photographs, designs and descriptions are illustrative — small variations in colour, finishing or packaging may exist depending on the manufacturer's production batch.
Product availability is subject to stock. The classification Stock in Spain, Stock in Korea and Pre-Order indicates where the inventory is located and directly affects delivery times — see section 8.
Prices on the Website are shown in Euros (€) and include VAT (IVA) applicable in the Spanish Peninsula and the Balearic Islands, except where the tax regime of the destination requires a different treatment (Canary Islands — IGIC; Ceuta and Melilla — IPSI; exports outside the EU).
For orders shipped to the Canary Islands, Ceuta, Melilla or outside the European Union, the taxes and import duties of the destination country/region are the responsibility of the Customer and are not included in the price shown on the Website. More information in our IGIC / IPSI guide.
Unlike many competitors, for shipments within mainland Spain and the Balearic Islands KStory España assumes the import duties and handling costs of Korean products, so the price shown is the final price for the Customer.
KStory España reserves the right to modify prices at any time, without this affecting orders already confirmed prior to the change.
The contract is concluded exclusively in Spanish and/or English, and the confirmed order is archived by KStory España. The Customer may request a copy by writing to info@kstoryespana.es.
KStory España accepts the following payment methods, subject to availability at checkout: Visa, Mastercard, American Express, Apple Pay, Google Pay, Bizum, and bank transfer. Card and wallet payments are processed by certified PSD2-compliant providers (WooPayments, Stripe or equivalent).
Cash on delivery is not available. All orders are paid in advance.
Should the issuing bank decline the charge, or if the order is flagged by our anti-fraud systems, KStory España reserves the right to suspend or cancel the order and to request additional verification from the Customer.
Orders are dispatched from our warehouse in Málaga (Spain). Delivery times, counted in business days, depend on the product classification:
Once the order leaves our Málaga warehouse, the Customer receives an email with the tracking number. Random inspections by Spanish customs authorities may add 1–3 weeks of additional delay; this is outside of KStory España's control.

Pre-orders allow the User to reserve a product before its official release in Korea, guaranteeing availability and, where the manufacturer foresees it, access to exclusive gifts.
The full conditions of pre-orders (payment, gifts, exceptions, modifications) are detailed in our Pre-Order Policy, which forms an integral part of these Terms.
To exercise the right of withdrawal, notify us by email to info@kstoryespana.es with an unequivocal declaration (name, order number, product) or use the official withdrawal form available in Annex B of the TRLGDCU.
After notifying us, the Customer has a further 14 calendar days to return the product, in its original condition and packaging, to the address we provide. The direct cost of returning the goods shall be borne by the Customer, except when the return is due to an error or defect attributable to KStory España.
Reimbursement of the amount paid (including standard shipping costs) will be made within 14 calendar days from the receipt of the returned product, using the same payment method used in the original transaction.
Pursuant to art. 103 TRLGDCU, the right of withdrawal does not apply to:
In addition to the legal right of withdrawal, our extended return policy — including the mandatory unboxing video, exchange for defective products and shipping-cost rules — is available in our Returns & Refunds Policy, which forms an integral part of these Terms.
All products benefit from the legal guarantee of conformity set out in articles 114 ff. TRLGDCU: 3 years from delivery for new products and 1 year for second-hand products (where applicable).
During the first 2 years of the guarantee the lack of conformity is presumed to have existed at the time of delivery, unless proven otherwise. Claims under the legal guarantee must be sent to info@kstoryespana.es with a description of the defect, the order number and supporting photos/videos.
All content on the Website — texts, photographs, images, logos, trademarks, graphic design, source code — is the property of KStory España or of the licensors that have authorised their use, and is protected by Spanish and international intellectual property laws.
Reproduction, distribution, public communication or transformation of the content is prohibited without the prior written consent of its owner. Trademarks of K-POP artists, record labels and merchandise manufacturers displayed on the Website belong to their respective owners and are used exclusively to identify the products offered.
Personal data provided by the User is processed by K MOMENT EUROPE SL as Data Controller, under Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).
The purposes of the processing, the legal basis, retention periods, international transfers, and the procedure for exercising the rights of access, rectification, erasure, objection, limitation and portability, are detailed in our Privacy Policy.
Rights may be exercised by writing to info@kstoryespana.es. The User may also file a complaint with the Spanish Data Protection Agency (www.aepd.es).
The Website uses own and third-party cookies to ensure its proper functioning, analyse browsing and, with the User's consent, display personalised content. Detailed information and consent management in our Cookie Policy.
KStory España shall be liable for any breach of these Terms attributable to it, in accordance with applicable law. However, KStory España shall not be liable for:
KStory España shall not be liable for the non-performance or delay in performance of its obligations when due to causes of force majeure: natural disasters, strikes, pandemics, transport blockages, customs closures, acts of public authority, or any other unforeseeable event.
KStory España reserves the right to modify these Terms at any time. The version in force at the time of the order shall apply to that order. Users will be notified of substantial modifications through the Website and, where appropriate, by email.
These Terms are governed by Spanish law. For any dispute arising from the interpretation or performance of the Terms, the parties submit — without prejudice to the consumer forum provided for in art. 52.3 of the Spanish Civil Procedure Act and other mandatory rules — to the Courts and Tribunals of the consumer's domicile within Spain.
In accordance with Regulation (EU) 524/2013, consumers resident in the EU may submit disputes related to online purchases to the European Commission's ODR platform: ec.europa.eu/consumers/odr

Última actualización: 24 de abril de 2026Las presentes Condiciones Generales de Contratación y Uso (en adelante, las "Condiciones") regulan el acceso, la navegación y la utilización del sitio web kstoryespana.com (el "Sitio Web") y la adquisición de productos ofertados a través del mismo por K MOMENT EUROPE SL (en adelante, "KStory España", "nosotros").
KStory España es una tienda física y online especializada en productos de cultura pop coreana (álbumes de K-POP, merchandising, photocards, light sticks, revistas y artículos relacionados), importados directamente de distribuidores autorizados en Corea del Sur.
Mediante el acceso, la navegación o la realización de un pedido a través del Sitio Web, el usuario ("Cliente" o "Usuario") acepta expresamente las presentes Condiciones, así como nuestra Política de Privacidad, Política de Cookies, Política de Devoluciones y Reembolsos y Política de Pre-Orden.
Si el Usuario no estuviera de acuerdo con alguna de estas Condiciones, deberá abstenerse de utilizar el Sitio Web.
La navegación por el Sitio Web es libre. Para realizar un pedido el Usuario podrá comprar como invitado o crear una cuenta de usuario aportando una dirección de correo electrónico válida.
Para registrarse y realizar pedidos el Usuario deberá ser mayor de 18 años o, en caso de ser menor, contar con la autorización de un padre, madre o tutor legal. El Usuario es responsable de la veracidad de los datos facilitados y de la custodia de sus credenciales de acceso.
Los productos ofertados en el Sitio Web, junto con sus características principales y precio, se describen con la máxima precisión posible. Las fotografías, diseños y descripciones son ilustrativos — pueden existir pequeñas variaciones de color, acabado o packaging dependiendo del lote de producción del fabricante.
La disponibilidad de los productos está sujeta a existencias. La clasificación Stock in Spain, Stock in Korea y Pre-Order indica dónde se encuentra el inventario y afecta directamente al plazo de entrega — véase sección 8.
Los precios en el Sitio Web se muestran en Euros (€) e incluyen el IVA aplicable en la Península y Baleares, salvo cuando el régimen fiscal del destino requiera un tratamiento distinto (Canarias — IGIC; Ceuta y Melilla — IPSI; exportaciones fuera de la UE).
Para los envíos a Canarias, Ceuta, Melilla o fuera de la Unión Europea, los impuestos y aranceles de importación del país/región de destino son a cargo del Cliente y no están incluidos en el precio mostrado en el Sitio Web. Más información en nuestra guía IGIC / IPSI.
A diferencia de muchos competidores, para los envíos dentro de la Península y Baleares KStory España asume los aranceles de importación y los gastos de gestión de los productos coreanos, por lo que el precio mostrado es el precio final para el Cliente.
KStory España se reserva el derecho a modificar los precios en cualquier momento, sin que dicha modificación afecte a los pedidos ya confirmados con anterioridad.
El contrato se formaliza exclusivamente en español y/o inglés, y el pedido confirmado queda archivado por KStory España. El Cliente podrá solicitar una copia escribiendo a info@kstoryespana.es.
KStory España acepta los siguientes métodos de pago, sujetos a disponibilidad en el checkout: Visa, Mastercard, American Express, Apple Pay, Google Pay, Bizum y transferencia bancaria. Los pagos con tarjeta y wallets se procesan a través de proveedores certificados conformes a PSD2 (WooPayments, Stripe o equivalente).
No se admite el pago contra reembolso. Todos los pedidos se abonan por adelantado.
En caso de denegación del cargo por parte del banco emisor, o si el pedido es marcado por nuestros sistemas antifraude, KStory España se reserva el derecho de suspender o cancelar el pedido y solicitar una verificación adicional al Cliente.
Los pedidos se envían desde nuestro almacén de Málaga (España). Los plazos de entrega, en días laborables, dependen de la clasificación del producto:
Una vez el pedido sale de nuestro almacén de Málaga, el Cliente recibe un correo electrónico con el número de seguimiento. Las inspecciones aleatorias por parte de las autoridades aduaneras españolas pueden añadir de 1 a 3 semanas de demora adicional; esta circunstancia queda fuera del control de KStory España.

Las pre-órdenes permiten al Usuario reservar un producto antes de su lanzamiento oficial en Corea, garantizando la disponibilidad y, cuando así lo prevea el fabricante, el acceso a regalos exclusivos.
Las condiciones completas de las pre-órdenes (pago, regalos, excepciones, modificaciones) se detallan en nuestra Política de Pre-Orden, que forma parte integrante de estas Condiciones.
Para ejercer el derecho de desistimiento, notifíquenoslo por correo electrónico a info@kstoryespana.es mediante una declaración inequívoca (nombre, número de pedido, producto) o utilizando el formulario oficial disponible en el Anexo B del TRLGDCU.
Tras la notificación, el Cliente dispone de otros 14 días naturales para devolver el producto, en su estado y embalaje originales, a la dirección que le facilitemos. Los costes directos de devolución serán a cargo del Cliente, salvo cuando la devolución se deba a un error o defecto imputable a KStory España.
El reembolso del importe abonado (incluidos los gastos de envío estándar) se realizará en un plazo de 14 días naturales desde la recepción del producto devuelto, utilizando el mismo medio de pago empleado en la transacción original.
De conformidad con el art. 103 TRLGDCU, el derecho de desistimiento no se aplica a:
Además del derecho legal de desistimiento, nuestra política ampliada de devoluciones — que incluye el vídeo de unboxing obligatorio, el cambio por producto defectuoso y las reglas de gastos de envío — está disponible en nuestra Política de Devoluciones y Reembolsos, que forma parte integrante de estas Condiciones.
Todos los productos gozan de la garantía legal de conformidad establecida en los artículos 114 y siguientes del TRLGDCU: 3 años desde la entrega para productos nuevos y 1 año para productos de segunda mano (cuando corresponda).
Durante los 2 primeros años de la garantía se presume que la falta de conformidad existía en el momento de la entrega, salvo prueba en contrario. Las reclamaciones bajo garantía legal deben enviarse a info@kstoryespana.es con descripción del defecto, número de pedido y fotos/vídeos justificativos.
Todos los contenidos del Sitio Web — textos, fotografías, imágenes, logotipos, marcas, diseño gráfico, código fuente — son propiedad de KStory España o de los licenciantes que hayan autorizado su uso, y se encuentran protegidos por la normativa española e internacional de propiedad intelectual e industrial.
Queda prohibida la reproducción, distribución, comunicación pública o transformación de los contenidos sin el consentimiento previo y por escrito de su titular. Las marcas de artistas de K-POP, sellos discográficos y fabricantes de merchandising mostradas en el Sitio Web pertenecen a sus respectivos titulares y se utilizan exclusivamente para identificar los productos ofertados.
Los datos personales facilitados por el Usuario son tratados por K MOMENT EUROPE SL como Responsable del Tratamiento, conforme al Reglamento (UE) 2016/679 (RGPD) y a la Ley Orgánica 3/2018 (LOPDGDD).
Las finalidades del tratamiento, la base jurídica, los plazos de conservación, las transferencias internacionales, y el procedimiento para ejercer los derechos de acceso, rectificación, supresión, oposición, limitación y portabilidad, se detallan en nuestra Política de Privacidad.
Los derechos pueden ejercerse escribiendo a info@kstoryespana.es. El Usuario podrá asimismo presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es).

KStory España responderá de cualquier incumplimiento de las presentes Condiciones que le sea imputable, conforme a la normativa aplicable. No obstante, KStory España no será responsable de:
KStory España no será responsable del incumplimiento o retraso en el cumplimiento de sus obligaciones cuando se deba a causas de fuerza mayor: catástrofes naturales, huelgas, pandemias, bloqueos de transporte, cierres aduaneros, actos de autoridades públicas o cualquier otro suceso imprevisible.
KStory España se reserva el derecho a modificar las presentes Condiciones en cualquier momento. La versión vigente en el momento de realizar el pedido será aplicable a dicho pedido. Los Usuarios serán notificados de las modificaciones sustanciales a través del Sitio Web y, en su caso, por correo electrónico.
Las presentes Condiciones se rigen por la legislación española. Para cualquier controversia derivada de la interpretación o ejecución de las Condiciones, las partes se someten — sin perjuicio del fuero del consumidor previsto en el art. 52.3 LEC y demás normativa imperativa — a los Juzgados y Tribunales del domicilio del consumidor dentro de España.
De conformidad con el Reglamento (UE) 524/2013, los consumidores residentes en la UE podrán someter las controversias relativas a compras online a la plataforma de resolución de litigios en línea de la Comisión Europea: ec.europa.eu/consumers/odr
